Merry Wrap respects the work of artists, illustrators, photographers and writers. Our wrapping paper patterns, ornament designs and stocking artwork are meant to be original, and the wording on each gift comes from our customers. If you believe something on merrywrap.shop copies a work you own, this page explains how to tell us under the United States Digital Millennium Copyright Act (DMCA), what information we need, what we do next, and how someone affected by a notice can respond. For trademarks and other kinds of intellectual property, see our Intellectual Property Policy.
Copyright notices in one glance
- Send notices to: support@merrywrap.shop, subject line “DMCA notice”.
- Postal address: Merry Wrap, 4317 NE 66th Ave, Vancouver, WA 98661, US.
- First reply: within 24 hours on business days, confirming we received the notice.
- Action on a complete notice: the material is removed or disabled promptly while we review it.
- Counter-notices: accepted from the person whose content was removed, as described in section 5.
1. What this page covers
This process applies to content published on merrywrap.shop: product images and previews, pattern artwork, ornament and stocking designs, written descriptions, page text, and any customer reviews or photos shown on the site. It also covers designs on items we sell, if you believe a design reproduces your copyrighted work.
It does not apply to the personalised wording printed on an individual customer’s gift, which is private and not published on the site. If you believe a customer has asked us to print your copyrighted work, such as song lyrics, a poem or an illustration, tell us using the same process and we will stop production of that order and contact the customer.
Copyright protects original creative works, such as artwork, photographs and text. It does not protect general ideas or common holiday themes. Plaid patterns, snowflakes, pine sprigs, candy canes, Santa hats and the words “Merry Christmas” are shared seasonal imagery that many designers use. A notice should point to the specific expression of your work that you believe has been copied, not to a general style.
2. How to send a copyright notice
Email support@merrywrap.shop with the subject line “DMCA notice”, or post it to the address above. To be valid under the DMCA, your notice must include:
- Your physical or electronic signature, as the copyright owner or a person authorised to act for the owner.
- A description of the copyrighted work you believe is infringed, such as a link to your original design, a portfolio page or a registration number.
- The exact location of the material on our site: the full URL of each product or page, and which image or text you mean if the page has several.
- Your contact details: name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
A notice that leaves out one of these items may delay our response, because we will need to come back to you for it. Screenshots are helpful but do not replace the URLs. If you are reporting several items, a list or table of URLs with a note for each is the quickest for both of us.
| Item | Example | Why we need it |
|---|---|---|
| Your original work | Link to your published illustration of a snowy cabin pattern | So we can compare the two works |
| Our URL | merrywrap.shop/products/… plus “second image” | So we remove the right material |
| Contact details | Name, address, phone, email | So we can reply and forward a counter-notice |
| Good-faith statement | One sentence, as in item 5 above | Required by the DMCA |
| Accuracy statement and signature | Typed full name counts as an electronic signature | Required by the DMCA |
3. What we do when we receive a notice
- We confirm receipt within 24 hours on business days.
- If the notice is complete, we promptly remove or disable access to the material identified, and pause sales of any product that uses it.
- If the material was supplied by someone else, such as a customer review photo, we tell that person what was removed and why, and give them a copy of the notice with your personal contact details shared only as the DMCA requires.
- We keep a record of the notice and our action.
Removing material in response to a notice is not an admission that it infringed anything. It is the step the law asks a service provider to take while the parties sort out the question.
4. If the material is our own design
Most designs on merrywrap.shop are created for Merry Wrap. If a notice concerns one of our own designs, we review our design records and how the artwork was made. If we find that a design does use your work without permission, we withdraw it permanently and work with you on a fair resolution. If we believe the design is original, we explain why, and we may restore it after the process in section 5. Either way, we answer you directly and honestly.
5. Counter-notification
If material you supplied was removed and you believe that was a mistake, or that you had the right to use it, you can send a counter-notice to the same address. It must include:
- Your physical or electronic signature.
- A description of the material removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Merry Wrap may be found), and that you will accept service of process from the person who sent the original notice.
When we receive a valid counter-notice, we forward it to the person who sent the original notice. Unless they tell us within 10 to 14 business days that they have filed a court action to stop the use, we may restore the material.
6. Misleading notices
Please only send a notice if you own the work or are authorised to act for the owner, and you have considered whether the use might be allowed, for example as a common seasonal motif. Under the DMCA, anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for the damages that result. We may decline notices that are clearly abusive or are attempts to remove a competitor’s products without a genuine copyright claim.
7. Repeat infringement
Where someone repeatedly submits infringing content, such as review photos taken from other people’s work, we may remove their ability to post content and, in appropriate cases, close their account. We also review our own designs whenever a valid notice shows a problem, so the same issue does not happen twice.
8. Typical timeline
| Stage | Who acts | Typical timing |
|---|---|---|
| Notice received | Merry Wrap confirms receipt | Within 24 hours on business days |
| Incomplete notice | We ask for the missing items | In the same reply |
| Complete notice | We remove or disable the material and pause related sales | Promptly after review |
| Person who supplied the material informed | Merry Wrap | After removal |
| Counter-notice (if any) | We forward it to the original sender | When received |
| Possible restoration | Merry Wrap, if no court action is reported | After 10 to 14 business days |
9. Before you send a notice: similar is not always copied
Holiday design has a shared vocabulary, and two independent artists can easily draw a red plaid with white snowflakes, a reindeer silhouette or a row of stockings on a mantel. When you compare our item with your work, look for the details that are truly yours: the exact drawing of a character, a distinctive composition, a recognisable colour arrangement, or text you wrote. If those match, please tell us, and we will take it seriously. If the similarity is only the theme, we may explain why we believe the design is independent, and you are still welcome to send a formal notice if you disagree.
If you are an artist and simply want to ask whether a design of ours was inspired by yours, you do not need a formal notice. Email us with a link to your work and we will look into it and reply in plain words.
10. Other rights
This page is for copyright. If your concern is a trademark (a brand name, logo or character name), a right of publicity (a person’s name or likeness), or another kind of right, please use the process in our Intellectual Property Policy. The information we need is similar, and we handle those reports with the same care and speed.
11. Customer wording and photos
Customers write their own personalisation in the order notes and may email us photos. Our Terms of Service ask them to send only wording and pictures they have the right to use, and we decline lyrics, characters, logos and photos that appear to belong to someone else. If you see an item in the wild that you believe was made by us using your work, please send us a photo and as much detail as you can; we will check our records and respond.
12. Reports from customers and the public
You do not have to be a copyright owner to point out a problem. If you notice a design on our site that looks like a well-known artist’s work, a famous illustration or a branded character, a short email is enough: tell us the product link and what it reminds you of. We review every such report, and if a design turns out to be a problem we withdraw it, even without a formal notice from the owner. Only the owner or their agent can send a formal DMCA notice, but anyone can help us keep the shop honest, and we are grateful when they do.
Please do not include personal information about other people in a report, and do not send us copies of copyrighted files you do not own; a link to where the work is published is enough.
