Intellectual Property Policy
Last updated:
A personalised gift brings together three kinds of creative work: our designs, your words, and sometimes your photos. This Intellectual Property Policy explains who owns what at Merry Wrap, what you may and may not do with our designs, why we turn down certain wording and images, and how to report a concern about trademarks, names, likenesses or other rights. Copyright notices under the DMCA follow the specific process on our DMCA page.
Intellectual property in one glance
- Our designs: patterns, artwork, photos, text and the Merry Wrap name and logo belong to Merry Wrap or are used with permission.
- Your wording and photos: stay yours; we use them only to make your order.
- What we will not print: brand logos, team names, licensed characters, song lyrics, and photos you do not have the right to use.
- Reports: email support@merrywrap.shop; we reply within 24 hours on business days.
1. What belongs to Merry Wrap
The following are owned by Merry Wrap or used under licence: the Merry Wrap name and the wordmark with a ribbon bow tied over the “W”; the website’s design, layout and text; our original wrapping paper patterns, ornament and stocking artwork; product photos and previews; and the guides, FAQs and policy pages on this site. These are protected by copyright, trademark and other laws in the United States and in the countries where we sell.
2. What you may do
- Use and enjoy the items you buy, including showing them in your home, giving them as gifts and sharing photos of them online.
- Share links to our product and information pages with friends and family.
- Quote a short passage from our pages, with a link back, when writing a review or recommendation.
- Print a page of our policies for your own records.
3. What you may not do
- Copy our patterns, artwork or product photos to make, sell or advertise products, whether printed, digital or as downloadable files.
- Use our name, logo or anything confusingly similar as a brand, domain name, social media account or in advertising.
- Present our designs or text as your own, or remove credits or watermarks.
- Scrape the site to build a catalogue or train automated systems on our designs and text.
- Imply that Merry Wrap endorses, sponsors or partners with you without our written agreement.
Buying an item gives you ownership of that physical item, not of the design printed on it. You may resell a gift you no longer want, but you may not reproduce the design.
4. The Merry Wrap name and logo
“Merry Wrap” identifies our shop and the gifts we sell. Please do not use it, or a name or logo that could be confused with ours, for holiday gifts, gift wrap, decorations or related goods. If you want to mention us, for example in a gift guide or blog post, you are welcome to use our name in plain text with a link to merrywrap.shop. For anything else, such as using our logo, please ask first by email.
5. Your wording and photos
The names, dates and messages you write in the order notes, and any photo you email us, remain yours. By sending them, you give us permission to use them only for one purpose: making and delivering your order, and dealing with any return or claim about it. We do not publish your wording or photos, add them to our design library, use them in advertising, or share them with anyone except a production partner where one helps make the item. Photos are deleted 30 days after your order is delivered, as described in our Privacy Policy.
When you send wording or a photo, you confirm that you have the right to use it. For most orders this is simple: your family’s names, a date that matters to you, a photo you took. It becomes a question when the content belongs to someone else, which is where section 6 comes in.
6. Respecting other people’s rights
Holiday gifts are a magnet for famous characters, team logos and favourite song lines. We understand why, but we cannot print them. Doing so would use someone else’s intellectual property without permission, and it is something we do not do on our designs or on yours. We decline personalisation that includes:
| Type | Examples | What we do |
|---|---|---|
| Trademarks and logos | Sports team names and logos, brand names, store names | Email you to offer plain wording instead, or refund |
| Licensed characters | Cartoon, film, game or toy characters and their names | Email you to offer plain wording instead, or refund |
| Copyrighted text | Song lyrics, lines from books, films or poems | Email you to suggest your own words, or refund |
| Photos you do not own | Professional photos without permission, images found online, celebrity photos | Ask for permission or another photo, or refund |
| Other people’s names or likeness used without consent | A public figure’s name or face presented as an endorsement | Decline and refund |
Ordinary names that happen to match a famous person, such as a child called Taylor, are of course fine. What we avoid is content that only makes sense as a reference to someone else’s brand, character or creative work. Seasonal words and common phrases, such as “Merry Christmas”, “Happy Holidays”, “Season’s Greetings” or “Baby’s First Christmas”, are free for everyone to use and we print them gladly.
7. Wording that works, and wording we have to decline
A few examples make the line clearer. These are the kinds of order notes we receive every December:
Wording we print gladly
- “Ornament: Ava’s First Christmas 2026” — a name, an occasion and a year.
- “Paper repeat: Merry Christmas, Love Nana” — a seasonal greeting and a family nickname.
- “Stocking: Biscuit” — a pet’s name, however unusual.
- “Ornament: Sam & Jordan, Est. 2019” — two names and a date that matters to them.
- “Paper repeat: The Millers, Ho Ho Ho” — a family name and a common holiday phrase.
Wording we would email you about
- A favourite team’s name and logo on a stocking cuff. We can print the child’s name and number instead, without the team’s name or emblem.
- A cartoon character’s name next to a child’s name. We can print the child’s name with a festive phrase instead.
- The opening line of a Christmas song that is still under copyright. We can print a short line in your own words.
- A photo taken from a professional photographer’s website. We can use a photo you took yourself, or one you have written permission to use.
In each case we pause the order and email you with a suggestion. If you would rather not change the wording, we cancel that item and refund it in full. We never quietly alter your wording or replace it with our own idea.
8. Using our designs in content you create
Many customers post photos of their gifts and Christmas morning online, and we love seeing them. You may share photos of items you bought, even though our designs appear in them. What we ask is that you do not crop or edit our designs to present them as your own artwork, and that you do not use them to promote another shop’s products. Bloggers and writers who want to feature our products in a gift guide may use our product images with a link to the product page; please email us first if you plan to use them in paid advertising or printed material.
9. How we create our designs
Our designs are made for Merry Wrap using common holiday themes: plaids, pine, snowflakes, stars, candy canes, cosy cabins, mittens and stockings. Those themes are shared by everyone who celebrates the season, but the specific artwork on our products is meant to be our own. We do not copy other shops’ designs, use other brands’ characters, or take images from the internet. When we use stock elements or fonts, we use them under their licence terms.
10. How to report a concern
If you believe something on our site or one of our products infringes your trademark, your right of publicity, or another intellectual property right, email support@merrywrap.shop with the subject “IP concern” and include:
- your name and contact details, and your relationship to the rights owner if you are acting for someone else;
- a description of the right, such as the trademark and where it is registered, or the name and likeness concerned;
- the URL of each page or product, and what on it you believe infringes;
- a statement that you believe in good faith the use is not authorised, and that the information you give is accurate.
For copyright in artwork, photos or text, please use the DMCA process, which has a few extra legal requirements.
11. What happens next
We confirm receipt within 24 hours on business days and review the report. Where the concern is valid or clearly plausible, we remove the material or pause the product while we look into it, and we tell you what we did. If we need more information, we ask. If we believe our use is lawful, we explain why. We keep records of reports and our responses. Where a design turns out to infringe, we withdraw it permanently.
12. Ideas and suggestions
We love hearing ideas for new patterns, ornament shapes or gift sets. If you send us an unsolicited idea, we may develop something similar without payment or credit, since many ideas reach us from different people at the same time. If you are a professional designer hoping to work with us, please say so in your email rather than sending finished artwork, and we will reply about how we work with designers.
13. Rights in Canada, Australia and New Zealand
We sell to customers in the United States, Canada, Australia and New Zealand, and we respect intellectual property rights under the laws of each of those countries, not only under US law. If you hold a trademark or other right registered in Canada, Australia or New Zealand and believe a product we ship there infringes it, use the same reporting process in section 10 and tell us where the right is registered. We review reports from any of these countries the same way and with the same reply time of 24 hours on business days.
14. Permission requests and contact
To ask permission to use our name, logo, images or text, email support@merrywrap.shop with what you would like to use and how. Postal address: Merry Wrap, 4317 NE 66th Ave, Vancouver, WA 98661, US. See also our Terms of Service and Contact Us page.
